AG warns NASA, Raila that oath plan is high treason

Attorney General Githu Muigai has said the swearing in of National Super Alliance (NASA) leader Raila Odinga slated for Tuesday, December will be null and void and will also amount to treason.

He said such an inauguration would be outside the Constitution because Kenya already has a sitting president who was inaugurated on November 28.

The AG also argues that the government has not been notified of any swearing in ceremony by NASA warning anyone who will take part in the planned alternative swearing in will face the full force of law.

“No person may claim state authority except as authorised by the constitution. A swearing-in of any other person not declared to have lawfully won an election by IEBC and administered by the Chief Justice is high treason in respect of the person involved and any other facilitating that process,” said the AG

Muigai cited the Constitution which prescribes death as the punishment for treason.

“What is the punishment for high treason? It is death,” he said.

Speaking at Sheria House on Thursday, the AG further said that NASA People’s Assembly is illegal and warned counties using public funds on such motions to be ready to account.

Such devolved Houses, he said, may be surcharged for misusing taxpayers’ money.

He stated that those pushing for the creation of the People’s Assembly institutions are undermining the rule of law and acting in contempt of court.
