DJ Evolve asks court to withdraw case against Babu Owino

Felix Orinda popularly known as DJ Evolve has through his family asked to withdraw the case against Embakasi East Member of Parliament Babu Owino following a shooting incident that occurred at B Club, Nairobi on January 16, 2020.

DJ Evolve has been nursing a gunshot injury which left him paralyzed with the legislature being charged with attempted murder.

In a letter to the court dated September 21, DJ Evolve through his lawyer Kenneth Mumbo explained that the family had decided to drop the case against Babu Owino so that the DJ can focus on getting better.

He added that the pending case had been affecting his healing process due to divided attention.

He went on to add that the family recognized that DJ Evolve and Babu Owino were friends before the unfortunate incident.

“The family had been on an intense deliberation on a need to allow the complainant, Orinda to concentrate on his treatment rather than the pending case which was affecting his healing process due to divided attention,” Mumbo said in a court document.

The Office of the Director of Public Prosecution (ODPP) which was represented by Joseph Riungu stated that it needed time sufficient time to give a comprehensive response.

He added that the ODPP will try and find the reason why the family made such a move adding that the office would need to talk to the victim.

In a ruling on Friday, October 16, Milimani Senior Principal Magistrate Benard Ochoi approved time for the prosecution to understand the family’s U-turn. He stated that the matter would be mentioned on November 9.

“It is my considered view that the application by the prosecution is merited and once the DPP satisfies himself of the issues raised, it is expected that a comprehensive response will be able to guide the status of this case going forward,” he stated.

DJ Evolve’s father in July 2020 revealed that the Babu Owino was still catering for the medical expenses incurred during his son’s home treatment.
