Uasin Gishu County Woman representative Gladys Shollei has shown support to that motion filed by the Law Society of Kenya to have Parliament dissolved for failure to meet the two-thirds gender rule.
This comes after at least six petitioners notified Chief Justice David Maraga that they were pushing for the dissolution of the Parliament for failing to meet the two-thirds gender rule in both the Senate and the National Assembly.
Shollei explained she was supporting the Law Society of Kenya because women’s issues were being taken lightly adding that they cannot allow unconstitutional Parliament to preside over Constitutional issues.
“The Law Society of Kenya has filed a petition to dissolve Parliament because it has failed to meet the two-thirds gender rule and I agree with them because women issues are human rights issues. We cannot allow an unconstitutional Parliament to preside over Constitutional issues,” she said.
She went on to question how the Constitution was going to be amended through Building Bridge Initiative (BBI) yet leaders were not willing to follow it in the first place. She added that there was no guarantee that they would follow the new Constitution.
“When you tell us that you want to amend the Constitutional issues through BBI, how do you amend a constitution that you have not followed in the first place? What guarantee do we have that you will actually follow whatever is in the Constitution that is coming our way? I want to assure the women of Kenya are going to agree with it but I know and believe the people of Kenya believe in observing the constitution, it shall carry the day and those amendments shall be implemented,” she added.
One of the six petitioners LSK President Nelson Havi argued that the two-thirds gender rule had not been met because of conflicting interests.
“Two-thirds gender requirement has not been met in Parliament and Executive for two reasons. One, political parties don’t submit compliant lists of nominees for election. IEBC accepts the lists. Two, the president refuses to ensure gender equality in Executive appointments,” he said.
