Wednesday July 11, 2018 – The Court of Appeal in Eldoret has reversed a High Court ruling that had nullified Nandi Hills MP, Alfred Keter’s victory during last year’s General Elections.
In his appeal, Keter through his lawyer, Otiende Omollo, argued that High Court Judge, Kanyi Kimondo, erred in law by nullifying the election based on evidence that was not factual.
Otiendo Omollo argued that Judge Kimondo used one ground that Keter campaigned in six places outside the stipulated time set by the Independent Electoral and Boundaries Commission (IEBC).
While making the ruling, Appellate Judge Erastus Githinji on behalf of the appeal judges said there was no evidence that Keter campaigned outside the stipulated time.
