According to Githu, NASA’s intentions of swearing in Raila Odinga were not provided for in the constitution, making it illegal.
Raila Odinga, on November 28, sensationally told his supporters that he would be sworn in as President on December 12 – Jamhuri day.
His announcement incidentally came parallel to President Uhuru Kenyatta’s inauguration ceremony in Kasarani.
AG Muigai has now sounded a warning to the NASA leader against his inauguration plans because he was not legally declared president by electoral body IEBC.
“There is proposed to be another swearing-in of another person. I want to start by saying for the avoidance of any doubt, the constitution provides in clear terms that no person may claim or exercise state authority except as authorised by the constitution,” He said.
According to criminal law in Article 40 of the Kenyan constitution, only the Chief Justice (David Maraga) was mandated to swear in a Head of State.
Any other activity of inauguration which is not foreseen by the CJ would be considered an act of treason.
The Attorney General’s warning comes just as Raila Odinga fiercely defended his swearing in agenda after the US urged him to “forget and move on”.
Raila told the US to keep off internal affairs of the country while accusing the international community of keeping silent as the State unleashed terror on its own people
